Part One: ASDA Business Rewards

Standard Terms & Conditions (Non Website/Transactional)

ASDA Business Rewards will supply ASDA Gift Cards in accordance with these terms and conditions. For the avoidance of doubt all other terms whether contained or referred to in a customer's order or in any other document, are hereby excluded.

1. ASDA Gift Cards

ASDA Gift Cards and ASDA Gift Vouchers are issued by ASDA Stores Ltd., Great Wilson Street, Leeds, LS11 5AD via ASDA Business Rewards.

ASDA Gift Cards can be used in any ASDA Store within the United Kingdom.

Payment for transactions may only take place at the check-out when the card is presented.

The balance of an ASDA Gift Card, can be used for in-store purchases in full or part payment (excluding third party concessions or products, Petrol and Lottery tickets) at any time.

ASDA cannot be held liable for lost/stolen Gift Cards or any credit amounts on such cards.

ASDA reserve the right to amend the terms and conditions that apply or discontinue the card at any time. Any notification of such change will be displayed at the Customer Service Desk in all ASDA Stores.

No change (Cash) will be given on an ASDA Gift Card or the balance on the ASDA Gift Card.

2. Purchase, Delivery & Supply

Whenever possible ASDA Gift Cards will be dispatched on the day cleared funds are received by ASDA Business Rewards prior to 1pm. If an order/cleared funds are received after 1pm, the Gift Cards will be dispatched the next working day. Please note that the date of dispatch and delivery to a customer is not of the essence.

Orders placed online through www.asdabusinessrewards.com can only receive a maximum of 2.5% discount.

Customers must notify ASDA Business Rewards as soon as they are aware of non-delivery, and in any event within 24 hours of due delivery date. Any short delivery of ASDA Gift Cards must be notified to ASDA Business Rewards within 3 days of delivery.

ASDA Gift Cards are not sold on a sale or return basis and no return will be permitted unless it can be demonstrated that ASDA Business Rewards has been in error in fulfilling the customer's order.

ASDA Gift Cards will be delivered to the customer by agreed delivery service. Risk will pass to the customer upon delivery, and title will pass upon receipt of cleared funds.

ASDA Business Rewards reserves the right to refuse to accept an order and also reserves the right to immediately suspend the fulfilment of an order if the customer is in breach of any of these terms and conditions.

No trade mark, service mark, corporate name or other trading name of ASDA or any of its subsidiary companies may be used by a customer without that customer first obtaining the prior written permission of ASDA Business Rewards.

If any of the provisions of this agreement shall be found by any court to be invalid or unenforceable such invalidity or unenforceability shall not affect the other provisions of this agreement which shall remain in full force and effect.

A person who is not a party to this agreement will acquire no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce or take the benefit of any of these terms and conditions.

Breach of these conditions will entitle ASDA Business Rewards to discontinue supply immediately and seek legal remedy available for injunction, damages or otherwise.

Customers may not sell ASDA Gift Cards to third parties unless they receive a contractual commitment from ASDA Business Rewards that the vouchers/gift cards will not be re-sold by them, or any subsequent purchaser, to groups or individuals at a discount.

This agreement to supply ASDA Gift Cards shall be governed by and construed in accordance with the laws of England and the English courts shall have exclusive jurisdiction.

ASDA Business Rewards reserves the right to alter any of the above terms and conditions but undertakes that before so doing it will serve a reasonable notice upon the customer. The customer may not vary the terms and conditions and any attempt to vary these terms will not be affective unless it is in writing and signed on behalf of ASDA Business Rewards.

Nothing in these terms and conditions shall affect a customer's statutory rights.

3. Data Protection Notice

Any personal or company data obtained will be held and processed in accordance with relevant legislation by ASDA Business Rewards and/or ASDA Stores Ltd

Personal or company data will not be passed to any other organisation unless it is necessary to do so to fulfill obligations under this consent.

A person or company has the right to request access to personal or company data held by ASDA Business Rewards and/or ASDA Stores Ltd. at any time by writing to ASDA Business Rewards.

ASDA Business Rewards should be informed of any inaccuracy in the data in order that it may be rectified. Information held may be used by ASDA Business Rewards and/or ASDA Stores Ltd., to send details of other products and services.

1. Ownership of Rights All rights, including copyright, in this website are owned by or licensed to Jordan Media. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Jordan Media. You may not modify, distribute or re-post anything on this website for any purpose.
2. Accuracy of Content Jordan Media Ltd has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website and at the discretion of Jordan Media. All prices are displayed inclusive of VAT where applicable Jordan Media shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
3. Damage to your Computer Jordan Media makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. 5. Availability All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
6. Ordering Errors You are able to correct errors on your order up to the point at which you click on "submit" on the final page of our ordering process.
7. Delivery Charges These are stated in the delivery options section of our website and appear in the final shopping basket prior to check out. Please refer to that section for full details.
8. Acknowledgment and Acceptance of your Order If you have supplied us with your email address, we will notify you by email to confirm receipt of your order. At this point the contract for our sale and your purchase of the goods shall be made on the terms set out herein and the contract shall be formed at the place from which our acceptance email is sent to you. If you have not supplied us with your email address, our confirmation of order page at the end of our ordering process will act as confirmation that we have received your order. You may print this page from the website to be kept for your own records.
9. Exclusions of Liability Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Jordan Media or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
